General terms and conditions

Art & Pictures Gallery/Creative Agency is registered with the Chamber of Commerce under number 71151400. HQ in Laren and exhibition space in Amsterdam.

Any natural person, legal entity or company to whom an offer is made by Art & Pictures Gallery, with whom an agreement is concluded or by whom an assignment is given to Art & Pictures Gallery, is defined as and referred to as "client". Any image, drawing, sample, design, sketch, sculpture, painting, art object or any other object or product designed, made, produced or conceived by artists associated with Art & Pictures Gallery is defined as and referred to as "work".

Offers and agreements

All offers are based on the assumption of execution of the agreement, assignment or activities under normal and regular circumstances. The customer cannot derive any rights from any information provided by Art & Pictures Gallery with regard to an offer, catalogue, brochure, price list, etc. An agreement with Art & Pictures Gallery is concluded upon express written acceptance by the customer and Art & Pictures Gallery. Any change, deviation or adjustment of the offer by the customer constitutes a rejection of the entire offer of Art & Pictures Gallery, as a result of which the offer is no longer applicable.

Prices and payment

All prices and amounts communicated, offered or agreed upon are in euros, net prices and inclusive of VAT. All amounts payable by the customer to Art & Pictures Gallery must be in euros. Unless otherwise agreed in writing between Art & Pictures Gallery and the customer, the amounts due on the invoice must be paid within seven days after the invoice date.

Delivery and ownership

The delivered works of Art & Pictures Gallery may only be used by the client for his own use or benefit based on normal and regular use of the work. The client acknowledges and agrees that the work may not be duplicated, copied, published and/or used for commercial, marketing or advertising activities or any other purpose than provided for in the agreement without prior written permission from and agreement with Art & Pictures Gallery.

Right of withdrawal and returns

Art & Pictures Gallery does not deliver from stock and has photo prints and art prints made to measure per order.

The General Terms and Conditions (and the Law) state : " The consumer can dissolve an agreement regarding the purchase of a product during a reflection period of at least 14 days without giving any reason. The entrepreneur may ask the consumer for the reason for withdrawal, but cannot oblige him to state his reason(s). "

There is, however, an exception to this . Namely, Article 10, paragraph 6 of the General Terms and Conditions: the delivery of products manufactured to the consumer's specifications, which are not prefabricated and which are manufactured on the basis of an individual choice or decision by the consumer, or which are clearly intended for a specific person.

Custom made art cannot be returned.

Original paintings are of course an exception to this.

Intellectual Property and Confidentiality

All intellectual property rights of the work are owned by Art & Pictures Gallery and remain with Art & Pictures Gallery. The work may be photographed by Art & Pictures Gallery. Art & Pictures Gallery may reasonably use the (photographs of) work for the promotion of their own activities and publicity. Without prior express written permission from Art & Pictures Gallery, the client may not adapt, change, modify or in any way combine the work of Art & Pictures Gallery.

Disputes and applicable law

All disputes arising out of or in connection with these terms and conditions and exclusively the competent courts in Amsterdam, the Netherlands, will settle the agreement. These general terms and conditions apply to and are deemed to be included in all offers made by Art & Pictures Gallery, all (sales and/or purchase) agreements with Art & Pictures Gallery, all orders to Art & Pictures Gallery and all other activities and/or services of Art & Pictures Gallery, now and in the future.
